 <title>Musicians to Picket FGO Superstar Concert Debut</title>

<description><![CDATA[Musicians will demand an end to orchestral outsourcing as they picket the Florida Grand Opera (FGO) Superstar Concert Series debut on January 10, 2009. Musicians are asking that patrons tell the FGO that the performance of an opera should contain more than a pickup orchestra and that the orchestra belongs in-house.<p>According to the musicians, the FGO must treat its musicians with respect if it truly wants a quality orchestra. The FGO has thrown its orchestral musicians, who have performed for the past eight seasons, out on the street, without any form of due process, and is offering no job security to the musicians currently performing in the FGO orchestra.<br /></p><p>The musicians also believe that artistic control should rest with the Music Director and not an outside entity that does not have a vested interest in the future of the FGO. All of the opera companies in the top fifteen metropolitan areas of the United States, except the FGO, hire their orchestras directly. These other major opera companies do not relinquish complete control of the orchestra to an outside entity. FGO has stated that they have no control over whom Miami Symphonic Services sends to the FGO pit. </p>]]></description>

 <title>STATEMENT ON FLORIDA GRAND OPERA PICKETING</title>

<description><![CDATA[Musicians will be picketing the Florida Grand Opera performance of La Traviata on November 15, 2008 to protest the fact that the orchestra of the past seven years has been replaced in its entirety.&nbsp;&nbsp;The recent replacement of the entire&nbsp; orchestra was made with the promise of higher quality.&nbsp; However, the change of orchestral contractor and the wholesale dismissal of the orchestral team were executed at great cost. The FGO has acknowledged that they have no control over the personnel of the orchestra, which will vary from performance to performance and will include student musicians. <br /> <br /> Florida Grand Opera is the only major opera company in the top fifteen metropolitan areas of the United States that does not hire their orchestra directly.]]></description>

 <title>FGO Update</title>

<description><![CDATA[<p>You may or may not be aware of the situation that currently exists between the Florida Grand Opera management and the musicians who have performed in the FGO orchestra for the past 7 seasons (and some for more than two decades).&nbsp; The opera&#39;s management has showed callous disregard for the years of service and dedication the musicians have provided and has decided to make a deal with a new orchestral contractor, Alfredo Oliva, apparently giving him carte blanche to hire whomever he chooses for this coming season, even if that means musicians from out of town or students. </p><p>The FGO management and Alfredo Oliva have both refused many requests to meet either with representatives of the FGO orchestra musicians or with Local 655. </p> <p>The Local Executive Board believes that now is the time for musicians to show unity and refuse to continue to work at the mercy of management&#39;s whims.&nbsp; We want the musicians of the FGO orchestra to be acknowledged as the actual employees of FGO, with a collective bargaining agreement and the job security they deserve.&nbsp; The opera, however, simply wants to continue to hire musicians through one independent contractor after another, grabbing the least binding situation they can, with no legal assurances or protections for the musicians.&nbsp; Musicians could once again suddenly be out of the work they count on. </p> <p>It is perhaps a little-known fact that the orchestra is the only element of the production which has no CBA &ndash; the chorus, the stagehands, the wardrobe department all operate with union contracts.&nbsp; There is no reason why the orchestra musicians should not be afforded the same respect and job security, a guarantee which the musicians of the Palm Beach Opera orchestra enjoy and deserve. </p> <p>We believe that musicians contribute an invaluable service to our community, and that only by standing together will we finally be able to receive the respect, security, compensation, and recognition that we deserve.</p>]]></description>

 <title>Local Requests FGO Be Placed on AFM Unfair List</title>

<description><![CDATA[Local 655 has requested that the Florida Grand Opera be placed on the American Federation of Musicians International Unfair List. Members of the AFM would be prohibited from rendering musical services to the Opera in accordance with AFM Bylaws, Article 8, Section 3. The Local expects that the request will be approved by the AFM when a petition for an election is filed with the National Labor Relations Board in the fall.Local 655 of the AFM is involved in a primary labor dispute with the Florida Grand Opera. An overwhelming majority of musicians performing for Florida Grand Opera have signed representation cards requesting to be represented by Local 655 in collective bargaining with the Opera. The Opera refuses to recognize Local 655 as the musicians&#39; bargaining agent. Additionally, the Opera refuses to recognize the musicians as employees of the Opera, stating that they are instead Independent Contractors. The Opera has also has also begun harassing the musicians and the Local by threatening to file lawsuits, including a lawsuit that attempts to prevent the musicians from referring to the Opera by name on their website and handbills, violating the musicians&rsquo; First Amendment and National Labor Relations Act rights.]]></description>

<description><![CDATA[<p style="margin-bottom: 0.1in"><strong>What&#39;s the difference between an employee and an independent contractor?</strong></p> <p style="margin-bottom: 0.1in">An independent contractor is a small businessman working for himself, whereas an employee works for someone else. An example of an independent contractor is a computer consultant, who can show up whenever he wants (or send someone else instead), do his work however he choses to without being directed by a supervisor, and gets paid a flat fee regardless of how long the work takes.  <title>Musicians Stage Protest</title>

<description><![CDATA[<p>Florida Grand Opera orchestra musicians vacated the orchestra pit as an act of solidarity at performances of La Boheme at the Broward Center for the Performing Arts on May 8 and 10, in protest of the Opera&#39;s refusal to recognize them as employees of the Opera company. After their usual pre-performance warm-ups, the orchestra quietly removed their instruments and left the pit en masse, while CEO and General Director Robert Heuer made his pre-performance speech from the stage overlooking the empty pit. <br /></p> Heuer announced the productions which will be presented during the 2008-2009 season, and requested the audience to renew their subscriptions for next year.&nbsp; Recent decisions by the Opera to refuse to recognize the musicians as employees and to engage a different orchestra contractor for next season mean that most of the current musicians will not be a part of the 2008-2009 orchestra.&nbsp; Their peaceful protest was carried out in order to attract the attention of the audience, most of whom have no idea that the opera&#39;s decision to bring in brand-new individual musicians for next season will affect the quality of the orchestra, which had been a solidly established ensemble during the past 7 years.<p> While the orchestra was waiting in the corridor for Heuer&#39;s speech to end, one employee of the opera was heard to say into her radio, &quot;Yes, it seems that the orchestra is in the hallway again....&quot;</p><p>The musicians returned to the pit after the conclusion of Heuer&#39;s speech to play both performances.</p>]]></description>

<description><![CDATA[ <p style="margin-bottom: 0.1in"><strong>What do the FGO musicians want?</strong></p> <p style="margin-bottom: 0.1in">The musicians wish Florida Grand Opera to recognize that the Opera is the true employer of the musicians. They also wish the Opera to recognize the musicians&#39; union as their bargaining representative.</p><p style="margin-bottom: 0.1in"><strong>Who Are the FGO Musicians?</strong></p> <p style="margin-bottom: 0.1in">The musicians are members of the community, teachers at local colleges and universities, teachers of local private music students. They are graduates of some of the most prestigious music schools in the country.</p> <p style="margin-bottom: 0.1in"><strong>How long have they performed for FGO?</strong></p> <p style="margin-bottom: 0.1in">The musicians as a group have performed for the Opera since 2000. Individually, several of the musicians performed for the Opera for several years prior to 2000 as members of the Greater Miami Opera Orchestra and/or the Florida Philharmonic.</p> <p style="margin-bottom: 0.1in"><strong>Hasn&#39;t the FGO always hired the orchestra through a third party? </strong> </p> <p style="margin-bottom: 0.1in">No. In fact, during the 1980&#39;s the Opera had their own orchestra, the Greater Miami Opera Orchestra. Because many of those musicians were also members of what was to become the Florida Philharmonic, the musicians voluntarily gave up their contract with the Opera on the condition that the Opera continue to employ them under the Florida Philharmonic contract as a joint employer. The Opera was a signatory to the Florida Philharmonic contract up until the time they began using the current orchestra.</p>]]></description>

<description><![CDATA[<p>The Florida Grand Opera has stated that they cannot afford to directly employ musicians. However, the numbers seem to indicate otherwise.
